Nothing in these terms and conditions will reduce your rights as a consumer relating to faulty
or incorrectly described goods or services.
“We” Focalpoint Optics.
“Goods” the goods that you order from us.
- The contract between us.
We must receive payment for the whole price for the Goods (including any delivery charge) before your order can be accepted.
Once we have received payment we will confirm that your order has been received by sending a confirmation e-mail to you at the e-mail address you provide on your order form. Our acceptance (all orders are checked prior to acceptance) of your order brings into existence a legally binding contract between us.
- Right for you to cancel your contract.
You may cancel your contract with us for the Goods at any time up to the end of the seventh working day from the date you receive the Goods. (Does not apply to special order items)
You do not need to give us any reason for cancelling your contract nor will you have to pay any penalty.
You cannot cancel your contract:
- if you have used the Goods to take any still or video recording;
- if you have taken any software out of the sealed package in which it was delivered to you;
- if the Goods are film, sensitised material, developing or printing matter; or
- if the Goods were made to your individual specification or personalised at your instruction.
- if the Goods are special order items (non stock items as indicated on this website).
To cancel your contract you must notify us in writing at the address specified at clause 13.
Once you have notified us that you are cancelling your contract, any sums paid to us for the Goods (but not the delivery charges) will be returned to you or re-credited to your account as soon as possible and in any event within 30 days of your order provided that the Goods are returned by you and received by us in the condition (including any accessories, packaging, instructions, free/promotional items etc) that they were in when delivered to you. If you do not return the Goods delivered to you or do not pay the costs of delivery, we shall be entitled to deduct the direct costs of recovering the Goods from the amount to be re-credited to you. You must also return any free gifts supplied with the Goods.
If you have received the Goods before you cancel your contract then you must send the Goods back to us at your own cost and risk. If you cancel your contract but we have already processed the Goods for delivery you must not unpack the Goods when they are received by you and you must send the Goods back to us at your own cost and risk within 7 days of delivery.
- Cancellation by Us.
We can cancel the contract between us if within seven working days from the date we accepted your order we:
- do not have sufficient stock to deliver the Goods;
- we do not deliver to your area; or
- one or more of the Goods was listed at an incorrect price/description due to a typographical error.
If we do cancel your contract we will notify you by e-mail and will return to you any sums paid as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment or inconvenience suffered.
The prices payable for Goods are as set out on our website.
You will be required to pay extra for delivery. Our delivery charges are set out on the delivery page of our website. (We reserve the right to amend any postage where you have selected in error the wrong postage type)
- Delivery of Goods
We can only deliver to mainland UK and Ireland for orders taken via this website.
We will deliver the Goods to the address you provide us with for delivery on the order form. (Please note that Credit Card orders must be delivered to the Credit Card address)
We will make every effort to deliver the Goods as soon as possible and in any event within 30 days of acceptance of your order.
Orders accepted on a Friday will not ordinarily be dispatched until the following Monday unless you have requested and paid for a Saturday delivery.
You will become the owner of the Goods when they have been delivered to you. Once the Goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction. (Please note that if you have an arrangement for goods being left, then this will be at your own risk not ours)
Where Goods are supplied with a manufacturers’ guarantee any claim under the guarantee should be made directly to the manufacturer or authorised UK distributor of the product. This does not affect your statutory rights as a consumer. Out of Box Faults will always be replaced as soon as the item has been returned and checked for faults. If the Goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing at the address specified in clause 13 below of the problem within 7 working days of the delivery of the Goods.
If you do not receive Goods ordered by you within 30 days of the date on which you ordered them, we shall have no liability to you unless you notify us in writing at the address specified in clause 13 below of the problem within 40 days of the date on which you ordered the Goods.
Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this term.
You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase Goods from our site. The importation or exportation of certain of our Goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the Goods you purchase.
Nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
- Events beyond our control.
We shall have no liability to you for any failure to deliver Goods or any delay in doing so or for any damage or defect to Goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
If any part of these terms and conditions is held by a court of competent jurisdiction to be invalid, void or unenforceable the remaining terms will not be affected.
- Governing law.
The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.
- Entire Agreement.
These terms and conditions, together with our current website prices, delivery details and contact details set out the whole of our agreement relating to the supply of the Goods to you by us. Nothing said by any sales person on our behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any Goods offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading. (Should you require something specific then please request the details in writing to avoid any misunderstandings)

All prices shown on this website include Vat unless otherwise stated, please ensure you have all the documentation you require if you wish to claim any VAT back, as we will not issue any VAT related documentation retrospectively.
